Please read these terms carefully before using our services.
Welcome to ServerByte. These Terms of Service ("Terms") govern your use of our website, products, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
ServerByte provides hosting services including, but not limited to, Virtual Private Servers (VPS), game server hosting, web hosting, and Discord bot hosting.
You must be at least 18 years old to purchase our Services, or have the consent of a parent or legal guardian who agrees to these Terms on your behalf.
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. If you believe your account has been accessed without authorization, contact us immediately at support@serverbyte.net. Please keep your account details accurate and up to date.
ServerByte offers managed and unmanaged hosting solutions. Each service plan includes specific resource allocations (CPU, RAM, storage, bandwidth) as described on the relevant product page at the time of purchase.
Unmanaged services (including VPS and game servers unless stated otherwise) give you full control of the server. We are responsible for the underlying hardware, network, and virtualization platform. You are responsible for the operating system, software, configuration, security updates, and the content you host. Our support covers infrastructure issues, not software or configuration inside your server.
Managed services (including shared web hosting) mean we maintain the server software, operating system, and control panel. You remain responsible for your own website content, application code, and account security.
We aim to keep all services available 99.9% of the time, measured monthly, as set out in Section 5. Scheduled maintenance windows will be communicated at least 24 hours in advance via email and our status page.
ServerByte reserves the right to modify, suspend, or discontinue any service with reasonable notice. Material changes to active service plans will be communicated at least 30 days in advance.
If we discontinue a service you have paid for in advance, or make a material change you do not accept, you may cancel and receive a pro-rata refund of the unused portion of your billing period, paid to your original payment method or as account credit at your choice.
Our services may be used for any lawful purpose. You are responsible for ensuring your use complies with all applicable local, national, and international laws, and for all content stored on or transmitted through your services.
The following activities are strictly prohibited:
Distribution of malware, viruses, or malicious software
Unauthorized access to other systems or networks
Sending unsolicited bulk email (spam)
Hosting content that infringes on intellectual property rights
Cryptocurrency mining of any kind
DDoS attacks or participation in botnets
Phishing, fraud, or impersonation
Hosting illegal content under applicable law
Your plan's resources are for your own use. Resource usage that degrades service for other customers may result in throttling or suspension. As a guide, "excessive" usage means sustained use of 100% of your allocated CPU for more than 4 consecutive hours, or disk I/O or network usage that noticeably affects other customers on the same host. We will attempt to notify you before taking action, except where immediate action is needed to protect other customers.
We respond to abuse reports, copyright notices, and complaints from network providers and law enforcement. Where a report is credible, we will forward it to you and normally give you 48 hours to resolve the issue. Where required by an upstream provider, by law, or to prevent ongoing harm, we may suspend the affected service immediately and notify you afterward.
ServerByte guarantees 99.9% availability of the network and host infrastructure for each service, measured monthly. "Downtime" means a period during which your service is unreachable due to a failure of our network, power, or host hardware, as recorded by our monitoring systems and status page.
The following are excluded from the uptime calculation:
Scheduled maintenance announced at least 24 hours in advance
Downtime caused by your own software, configuration, or actions
DDoS attacks or other malicious activity directed at you or at our network
Failures of upstream providers or third-party services outside our control
Suspensions for non-payment or Terms violations
Force majeure events, including natural disasters, power grid failures, and government action
If availability falls below the guaranteed level in a calendar month, affected customers are eligible for service credits:
99.0% – 99.9%: 10% credit of the monthly fee
95.0% – 99.0%: 25% credit of the monthly fee
Below 95.0%: 50% credit of the monthly fee
"Monthly fee" means the price of the affected service for one month. For quarterly, semi-annual, or annual plans, it is the plan price divided by the number of months in the billing cycle.
Service credits must be requested through a support ticket within 7 days of the end of the month in which the downtime occurred. Credits are applied to your account balance, are used against future invoices, are not refundable as cash, and expire 12 months after they are issued.
All services are billed in advance according to the selected billing cycle (monthly, quarterly, semi-annually, or annually). Renewal invoices are issued 7 days before the service end date and are due 3 days after they are issued. Payment is manual: nothing is charged automatically. Full details are on our Payments page.
Your service is never suspended before the end of the period you have paid for. If a renewal invoice is still unpaid on the service end date, the service is suspended. If it remains unpaid 7 days after suspension, the service is terminated and data is deleted in accordance with Section 8.3.
Paying a renewal invoice at any point during the suspension period restores the service. An unpaid renewal invoice is treated as a decision not to renew; it does not create a debt owed to ServerByte.
If you have a problem with a charge, please contact us first - we can resolve most billing issues quickly. If a chargeback or payment dispute is opened with your bank or PayPal, all services on the account may be suspended until the dispute is resolved. Where a chargeback is found to be unjustified, we may charge you the fees imposed on us by the payment provider and may decline further business.
Price increases for existing services will be communicated at least 30 days before the next billing cycle. You may cancel before the new price takes effect.
New customers are eligible for a full refund of their first VPS or web hosting purchase within 7 days of service activation if unsatisfied. This applies once per customer, to the first purchase only. Game server hosting and Discord bot hosting are not covered by the money-back guarantee.
If your first purchase included non-refundable items (see 7.2), the refund covers the hosting service only.
The following are not eligible for refunds:
Domain registrations
Game server hosting and Discord bot hosting
Services terminated for Terms of Service violations
Partial billing period refunds after the 7-day period, except where ServerByte discontinues or materially changes the service (see 3.4 and 11)
Setup fees, if any were charged
Approved refunds will be processed within 5–10 business days using the original payment method.
You retain full ownership of all data stored on our servers. ServerByte will not access, modify, or share your data except as required to provide the service, to investigate a credible abuse report, or as required by law.
ServerByte maintains system-level backups for our own disaster recovery. These backups are not available for individual customer restores and should not be relied upon. You are responsible for maintaining your own backups of all data you consider important. We recommend a regular backup schedule stored outside ServerByte.
When a service ends, your data is permanently deleted as follows:
Non-payment: the service is suspended on the service end date and data is permanently deleted 7 days after suspension.
Cancellation by you: data is retained for 7 days after the end of the paid period, then permanently deleted.
Termination by ServerByte for Terms violations: data is retained for 7 days after termination, then permanently deleted, unless we are required by law to retain or hand it over.
You may request immediate deletion at any time. Once deleted, data cannot be recovered.
To the maximum extent permitted by law, ServerByte provides services "as is" without warranties beyond those explicitly stated in these Terms. We are not liable for indirect, incidental, or consequential damages arising from use of our services, including loss of data, loss of profits, or business interruption.
To the maximum extent permitted by law, our total liability for any claim shall not exceed the amount paid by you for the affected service in the 12 months preceding the claim.
Nothing in these Terms limits or excludes rights you have under applicable consumer protection law, or our liability for death, personal injury, fraud, or gross negligence.
You may cancel your services at any time through your client panel. Cancellation takes effect at the end of the current billing period, and your service remains active until then. You may also simply leave a renewal invoice unpaid; see Section 6.2.
We may terminate services immediately and without refund for serious Terms violations (for example, illegal activity, abuse, or attacks on other systems). For other violations, we will provide 48 hours' notice and an opportunity to resolve the issue before termination.
ServerByte may update these Terms from time to time. Material changes will be communicated via email at least 14 days before taking effect. If you do not accept a material change, you may cancel before it takes effect and receive a pro-rata refund of any unused prepaid period. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United Kingdom. Any dispute that cannot be resolved informally will be subject to the courts of London, United Kingdom, without prejudice to any mandatory consumer rights that allow you to bring a claim in your own country of residence.
